I'm coming on once again about another "house issue". Is this ever going to end???? This is the letter we received Sat. from the place that sold us this modular home. Our supposed friend who sold it has retired at age 52, how convenient for him huh? Anyhow I need to use my assertive skills this morning in spite of my headache and stomach ache. I told my husband I want to talk to him. My husband is very stressed too since he's been the main one trying to handle it. I sent a video and pictures to Indiana where the house was put together. This is the letter. It's short. We received it Sat.

"I received a copy of the fax you sent to Admiration Homes and I am wondering what you want from us at this point. Since all the work we put into doing our agreement on service is now different, because you paid Dale to do it, I'm at a loss. Please contact me with some insight on what made you decide to ignore our agreement and how you would like to procede from here. Heritage Homes Inc. Don

Ok so my answer "our agreement" me, what agreement??? I begged him to get workers here and told him I'd be leaving April l5 and gone that week. I'd like to come home to a fixed home. DID HE EVEN CALL ME???? Our friend who works for another company tried 3X to phone them to tell them he was planning to do the work if they didn't come out and we'd charge them for it. Our friend did the work and presented us the bill which that is now what we want. We want them to pay it. He's at a loss???? How long did we have to wait and not even a phone call from either him or the company in Indiana. "How you would like to procede from here." DUH....Obviously since they didn't fix it, we'd like to be paid for what we paid someone else to fix plus our drainfield still is a problem that they should take care of.

OK, getting that off my chest pray that I'm assertive to ask for what we want and not get angry. I gotta keep my cool. This too shall pass. I will come back and let you know what happened. Thanks for prayers.

Barb, I don't know if this will help, but my husband always made me deal with insurance companies after storms or car accidents. I always wrote a letter then went back and edited it a few times to make sure I sounded confident and less emotional. I could never do that by phone or in person. I could never think of the right thing to say, but a letter helped me stick to my guns and gave me a written record of what was going on.
And just tell them "Because you failed to.....we believe we are entitled to 1...2...and 3..." Put the ball back in their court. Like my husband says, the squeakie wheel gets the oil. So squeak away!

This is a tough place to be in. They have all the rules, and you have all the bills. bevhembree is right written proof that you made all the efforts you are talking about to get them to do the work, is vital, the law is on their side, there was an agreement, and it is probably in small writing. you have to have the work done by them, is my guess. Wright or wrong, it is written, and that is what any judge will have to look at.
